Privilege Architecture: The Working Floor for Protected Proof

The Federal Rules of Evidence govern. The NCBE’s two sub-areas here are spousal, attorney-client, and medical privileges, plus subsequent remedial measures, settlements, and liability insurance. Logical relevance, hearsay, and credibility are separate admissibility questions from privilege.

This topic is NOT starred. Unstarred means legal resources may be supplied when the topic is tested. If it is tested without resources, you need only demonstrate recognition that the topic is at issue. You are not required to hold this topic cold because resources may be supplied. Still, you need a working floor available fast: the vocabulary, the recognition triggers, the holder, the protected material, waiver, exceptions, and the order of the questions.

Recognize the issue when:

  • A spouse is subpoenaed to testify against a spouse, or is asked to repeat something privately communicated during the marriage.

  • A client’s email, conversation, or document passed through a lawyer is offered, especially when an outsider was present or the client disclosed it later.

  • A doctor, therapist, hospital, or medical record appears, particularly when a party claims a mental or physical condition.

  • A defendant repaired, changed, or warned about a condition after an injury.

  • A party made a settlement offer after disputing liability or amount, or evidence mentions liability insurance.

Use this gateway:

  1. Identify the relationship or policy rule invoked.

  2. Identify the holder when the doctrine is relationship-based.

  3. Ask whether the material is a protected confidential communication or information.

  4. Ask whether the holder waived protection.

  5. Ask whether a recognized exception applies.

  6. For a policy exclusion, identify the purpose for which the evidence is offered.

You need not hold exact element wording, exception lists, or numbered subsections. You do need to recognize the doctrine’s name, know which person controls it, distinguish communication from underlying fact, and know whether the question is about confidentiality or about an impermissible use. Then read the supplied provision for operative language, conditions, and exceptions, and map each fact onto it.

Federal privilege questions generally arise under the federal common-law approach preserved by the Federal Rules, especially Rule 501. A privilege is not a general rule against relevant proof: it protects specified communications or information from compelled use. A policy exclusion instead restricts particular evidence for particular purposes.

Three Protected Relationships: Who Holds the Shield

The three relationships use similar vocabulary but protect different things.

DoctrineWho holds or may claim itWhat it protectsWaiver questionImportant limits or exceptions
Spousal testimonial privilegeThe witness-spouseThe witness-spouse’s compelled adverse testimony against the other spouse in a criminal caseDid the witness-spouse voluntarily testify or surrender the protection? It generally applies only while the parties are married at the time of testimony and does not protect all evidence or ordinary observations
Confidential marital communicationsBoth spouses have an interest in the confidential communicationA communication made privately between spouses during the marriageDid either spouse consent to disclosure or disclose the communication to an outsider? It survives divorce, but does not protect acts, observations, or nonconfidential statements; recognized crime-related exceptions may apply
Attorney-client privilegeThe client; the lawyer ordinarily asserts it for the clientConfidential communications made to obtain or provide legal advice, including necessary agentsDid the client or an authorized person voluntarily disclose the communication to an unnecessary outsider? It does not protect underlying facts or preexisting documents merely given to counsel; crime-fraud and certain lawyer-client or joint-client disputes are exceptions
Medical or psychotherapist privilegeThe patientConfidential communications made for diagnosis or treatment within a protected professional relationshipDid the patient consent, disclose the communication, or put the protected condition directly in issue under the governing authority? The FRE does not create a general physician-patient privilege; federal law recognizes psychotherapist protection, and the supplied authority controls

Spousal testimonial privilege is testimony-based. In a criminal proceeding, the witness-spouse may generally refuse to give adverse testimony against the other spouse. The accused spouse does not own the privilege; the witness-spouse does. The privilege is therefore different from a rule protecting particular marital conversations. It generally depends on marriage when testimony is sought, not on when the underlying events occurred.

Confidential marital communications privilege is communication-based. It protects a private communication made during the marriage, whether the proceeding is civil or criminal, and the protection ordinarily continues after divorce. It does not protect a spouse’s independent observation, physical act, or statement made where confidentiality was not intended. Ask separately whether the communication furthered joint criminal or fraudulent activity or falls within another recognized exception.

Attorney-client privilege requires more than the presence of a lawyer. Ask whether the client communicated with a lawyer, or with a necessary agent, for the purpose of obtaining or providing legal advice; whether the communication was intended to remain confidential; and whether the asserted holder is the client. A client’s underlying facts remain discoverable even when the client tells those facts to a lawyer. A preexisting business record does not become privileged merely because counsel receives it.

An unnecessary third person’s presence can defeat confidentiality. By contrast, an interpreter, employee, or other person reasonably necessary to obtain legal advice may preserve it. The privilege does not protect a client’s communication made to help the lawyer carry out a future crime or fraud. It does protect a client’s account of past conduct when the communication seeks advice rather than assistance in future wrongdoing.

Medical-patient confidentiality requires careful federal-law recognition. The FRE does not supply a general doctor-patient evidentiary privilege. The federal psychotherapist privilege protects confidential communications made to a psychotherapist for diagnosis or treatment of a mental or emotional condition. The patient holds that privilege. A patient’s voluntary disclosure, consent, or direct reliance on the condition may create waiver under the governing authority, but do not assume that every ordinary injury claim waives all treatment communications. Separate communications from underlying medical facts and observations.

Policy Exclusions at the Settlement Table: Purpose Controls the Door

Policy exclusions do not depend on a confidential relationship or a privilege holder.

Subsequent remedial measures are later repairs, safety changes, warnings, or similar steps taken after an injury or harmful event to make recurrence less likely. Rule 407 bars them when offered to prove negligence, culpable conduct, a defect, or a need for a warning or instruction. The same evidence may be used for another permitted purpose, such as proving ownership, control, or feasibility when that point is disputed, or for impeachment where the rule permits.

Compromise evidence is covered when there is a claim disputed as to validity or amount. Rule 408 protects an offer, acceptance, promise, or valuable consideration made to compromise that claim, along with conduct or statements made during negotiations about the claim. The bar applies when the evidence is offered to prove or disprove the claim’s validity or amount, or to impeach by contradiction or a prior inconsistent statement. It does not create a general secrecy rule: permitted uses include proving bias or prejudice, negating undue delay, and proving an effort to obstruct a criminal investigation or prosecution.

Liability insurance is treated under Rule 411. Evidence that a person was or was not insured against liability is not admissible to prove negligent or otherwise wrongful conduct. It may be admitted for another purpose, such as showing bias, agency, ownership, or control. Insurance evidence is therefore purpose-sensitive, not absolutely forbidden.

The supplied provision below illustrates how to read the operative purpose language:

Federal Rule of Evidence 408

Prohibited Uses. Evidence of the following is not admissible on behalf of any party-either to prove or disprove the validity or amount of a claim or to impeach by a prior inconsistent statement or a contradiction:

(1) furnishing, promising, or offering-or accepting, promising, or offering to accept-a valuable consideration in compromising or attempting to compromise the claim; and

(2) conduct or a statement made during compromise negotiations about the claim-except when offered in a criminal case and when the negotiations related to a claim by a public office in the exercise of its regulatory, investigative, or enforcement authority.

Exceptions. This rule does not require exclusion if the evidence is offered for another purpose, such as proving a witness’s bias or prejudice; negating a contention of undue delay; or proving an effort to obstruct a criminal investigation or prosecution.

A pedestrian, Lila, sued Metro Delivery for negligence after a collision.

Before trial, Metro denied both negligence and the amount demanded, so validity and amount were disputed.

Metro emailed Lila: “Metro offers $30,000 to resolve the claim. This offer is not an admission.”

Lila later alleged that Metro delayed the case by refusing to engage promptly. Metro offers the email solely to rebut that allegation of undue delay.

One Workflow for Protected Proof: From Trigger to Ruling

Run the fact pattern in this order:

  1. Name the trigger. Is the fact about a spouse, lawyer, treatment relationship, later repair, disputed settlement, or liability insurance?

  2. Classify the protection. For a relationship privilege, identify the holder and ask whether the proof is a protected confidential communication. For a policy rule, identify the specified excluded evidence.

  3. Test confidentiality and waiver. Ask whether disclosure was voluntary, whether an unnecessary outsider received the communication, and whether the holder consented or placed the protected matter directly in issue.

  4. Check exceptions. Look for future crime-fraud, joint-client or lawyer-client disputes, crime-related marital communications, or an exception stated in the supplied authority.

  5. For policy exclusions, test purpose. Exclude only the use the rule forbids. Admit a permitted non-liability use if the provision allows it.

  6. State the ruling precisely. Say “protected communication,” “waived,” “exception applies,” or “excluded for that purpose,” rather than treating every privilege or policy rule as an absolute evidence ban.

Hypothetical: After divorce, a prosecutor asks a former spouse to repeat a private statement made during the marriage.

Answer: Testimonial privilege generally does not apply because the witness is no longer married, but confidential marital communications privilege may survive divorce.

Recurring errors:

  • Treating a spouse’s observation of conduct as a marital communication when no statement was made.

  • Giving the attorney the privilege when the client, not the lawyer, controls it.

  • Assuming a preexisting report becomes privileged merely because the client handed it to counsel.

  • Calling every doctor-patient exchange privileged under federal evidence law despite the absence of a general physician-patient privilege.

  • Applying Rule 408 when no claim was disputed as to validity or amount.

  • Excluding a settlement offer used to show undue delay even though that purpose is expressly permitted.

  • Treating a later repair as forbidden when the evidence is offered for disputed control or feasibility.

  • Treating liability insurance as inadmissible for every purpose instead of asking why it is offered.

A standalone multiple-choice question may supply a rule excerpt and test the trigger, holder, waiver, exception, or permitted purpose. An integrated question set may require you to separate a protected communication from an underlying fact and then identify the evidence’s offered purpose. A performance task may ask you to use supplied authority to advise whether testimony, records, negotiation material, or insurance evidence can be used and why.

High-Yield Points - ⚡ Biggest Takeaways

Identify the holder before deciding whether a relationship privilege applies. Confidential marital communications survive divorce while testimonial privilege generally does not. Attorney-client privilege protects confidential legal-advice communications, not underlying facts or preexisting documents. Policy exclusions turn on the evidence’s purpose, with permitted non-liability uses remaining available.

                Flashcards: Privileges and policy exclusions

                1. 1. What does the federal psychotherapist-patient privilege protect?

                  Show answer

Under Jaffee, it protects confidential communications between a patient and a licensed psychotherapist or clinical social worker made during diagnosis or treatment; the privilege has no general balancing exception and may be waived by voluntary disclosure.

                2. 2. What does Rule 409 exclude, and what does it leave admissible?

                  Show answer

Rule 409 excludes offers, promises, or actual attempts to pay or furnish medical, hospital, or similar expenses resulting from an injury, but it does not exclude accompanying admissions, conduct, or statements.

                3. 3. When are subsequent remedial measures excluded under Rule 407?

                  Show answer

A measure taken after an injury or harm that would have made the earlier injury less likely is inadmissible to prove negligence, culpable conduct, a defect, or a need for a warning or instruction. It may be admitted for another purpose, such as proving ownership, control, or feasibility when controverted, or for impeachment.

                4. 4. What does Rule 411 provide concerning liability insurance?

                  Show answer

Evidence that a person was or was not insured against liability is inadmissible to prove that the person acted negligently or wrongfully. It may be admitted for another relevant purpose, such as proving bias, agency, ownership, or control.

                5. 5. What is the common-interest rule for attorney-client communications?

                  Show answer

Parties with a shared legal interest may disclose privileged communications to one another or their attorneys without waiving the attorney-client privilege as to outsiders. The protection applies only while the parties share a common legal interest, not merely a common business or financial interest.

                6. 6. How do the two spousal privileges differ?

                  Show answer

The spousal testimonial privilege generally permits a witness-spouse to refuse to testify against the other spouse in a criminal case, while the confidential marital communications privilege protects confidential communications made during the marriage in civil or criminal cases. The testimonial privilege belongs to the witness-spouse; both spouses generally hold the marital-communications privilege, which survives divorce.

                7. 7. What must exist before Rule 408 excludes compromise negotiations?

                  Show answer

There must be a disputed claim as to validity or amount, and a compromise offer, acceptance, or related conduct or statements made during negotiations to resolve it. The evidence is excluded when offered to prove or disprove the claim or to impeach, but may be admitted for another purpose.

                8. 8. Who holds the attorney-client privilege, and how may it be waived?

                  Show answer

The client holds the privilege, and the client may waive it by voluntarily disclosing the protected communication to a third party. The privilege does not apply to communications made to further a crime or fraud.

                9. 9. What communications does the attorney-client privilege protect?

                  Show answer

Under the majority rule, it protects confidential communications between a client and a lawyer or their agents made for the purpose of obtaining or providing legal advice. It does not protect underlying facts, business advice unrelated to legal advice, or communications made in the presence of unnecessary third parties.

                10. 10. What is the majority rule for the physician-patient privilege?

                  Show answer

In jurisdictions recognizing it, the privilege protects confidential communications made by a patient to a physician for diagnosis or treatment, and the patient holds the privilege. Common exceptions include putting the medical condition in issue, voluntary waiver, and communications made for purposes other than treatment.
