Regulatory Collision: Federal Priority and State Law

The Supremacy Clause makes the Constitution, valid federal statutes, and valid federal regulations superior to conflicting state law. Preemption is the doctrine that identifies when federal law displaces state law. First confirm that the federal enactment is valid; an invalid federal law cannot preempt a state rule. Then classify the preemption claim.

  • Express preemption: Federal text expressly says that state law is displaced. Read the provision’s operative language and its exceptions literally.
  • Field preemption: Congress regulates so comprehensively that it leaves no room for state regulation in the field. The subject may require nationally uniform treatment, or the federal scheme may be so pervasive that state supplementation is not permitted.
  • Conflict preemption: State and federal law cannot both operate. This includes:
    • Impossibility preemption: A regulated person cannot comply with both laws.
    • Obstacle preemption: State law stands as an obstacle to accomplishing federal purposes, objectives, or the full operation of the federal scheme.

A state rule can be preempted even when it does not contradict federal wording. Conversely, the existence of federal regulation does not automatically occupy the field or invalidate every state supplement.

Read supplied authority by locating the operative trigger, the consequence, and any stated exception. In Arizona v. United States, the Court treated the federal alien-registration system as occupying the field. The following passage supplies the governing rule:

“Field pre-emption reflects a congressional decision to foreclose any state regulation in the area, irrespective of whether state law is consistent with federal standards. Where Congress occupies an entire field, even a state law that is consistent with federal standards is pre-empted.”

A state statute requires every noncitizen to carry the federal registration card. The state argues that its rule merely assists federal enforcement and imposes no different substantive duty. The supplied passage makes the result direct: if the federal registration system occupies the entire field, consistency does not save the state law.

Congress enacts a federal alien-registration system requiring noncitizens to register with the federal government and carry a federal registration card. The system provides federal penalties for failing to register or carry the card. A state law makes failure to carry the same federal card a state misdemeanor. The state law does not impose any additional requirement.

Practice

Is the state law preempted?

A different-subarea check:

  • A state requires a federal airbase to obtain a state operating permit. Answer: Intergovernmental immunity bars the direct regulation of a federal instrumentality.

  • A state requires every truck entering the state to use a costly state-specific safety device, while offering little safety benefit. Answer: The neutral law is tested under Pike balancing because it burdens interstate commerce.

When States Regulate the United States: Immunity from State Control

Intergovernmental immunity protects the federal government and its instrumentalities from impermissible state taxation and regulation. A state may not directly tax the United States, federal property, or a federal instrumentality. It also may not discriminate against the federal government or those with whom it deals.

The protection is not a general exemption for every private transaction connected to federal activity. A state may impose a nondiscriminatory tax on private parties, including federal employees or contractors when the tax is imposed on them rather than directly on the United States. The key questions are who is legally taxed, what property or activity is regulated, and whether the measure singles out federal operations.

Direct regulation is likewise barred. A state cannot require a federal agency to obtain a state license, submit federal operations to state inspection, or follow state commands governing how the federal government performs its work. A generally applicable state rule directed at private parties may remain valid even if compliance incidentally increases federal costs. That is different from ordering the United States itself to act.

Worked application: A state imposes an annual “property assessment” on every owner of industrial land, including a federally owned naval depot. The assessment funds local services and applies at the same rate to private owners. The state cannot collect it from the depot. Equal treatment does not cure a direct tax on federal property. If the state instead taxed a private company operating under contract with the Navy, the analysis would ask whether the tax falls on the private company and applies without discrimination.

For regulation, change the facts so that the state requires the depot to obtain a state environmental permit before operating. That is direct regulation of a federal instrumentality and is barred unless the federal government has consented. The fact that the permit serves a legitimate local purpose does not convert the state command into a permissible rule for private actors.

The No-Commandeering Line: States Cannot Become Federal Administrators

The anti-commandeering doctrine prevents Congress from requiring state governments to legislate, administer, or enforce a federal regulatory program. The doctrine comes from New York v. United States, Printz v. United States, and Murphy v. NCAA.

Run the checklist by identifying the target of the federal command:

  1. If federal law regulates private persons directly, the law is not commandeering merely because state law is displaced or state officials must refrain from enforcing the conflicting state rule.
  2. If federal law orders a state legislature to enact a law, as in New York, the command is invalid.
  3. If federal law orders state executive officials to administer or enforce a federal program, as in Printz, the command is invalid.
  4. If federal law dictates that states may not authorize or repeal a particular state policy, as in Murphy, the command can be invalid even though it is phrased as a prohibition rather than an affirmative order.
  5. If Congress offers funds subject to stated conditions, a state that accepts the funds may be bound by those conditions; an offer with conditions is different from direct control of the state’s legislative or executive machinery.

The essential distinction is private regulation versus state administration. Congress may require private gun dealers, employers, or businesses to comply with federal standards. It may not require state officers to perform the federal background checks, investigate violations for federal purposes, or run the federal program. Likewise, federal preemption may leave a state with a choice: stop enforcing its conflicting law or change it. That consequence is not itself commandeering.

Worked application: Congress directs every state police department to conduct background checks for a federal firearms system and transmit the results to federal officials. The command targets state officers and requires them to administer a federal program, so it violates the anti-commandeering rule. If Congress instead requires firearms dealers to conduct the checks themselves, the target is private actors. The fact that dealers operate inside states does not turn the federal regulation into a command to state government.

Dormant Commerce and Market Access: State Burdens on Interstate Trade

The dormant Commerce Clause limits state laws that discriminate against or unduly burden interstate commerce when Congress has not authorized the state measure. Start by asking whether the law treats interstate commerce differently from in-state commerce.

A facially discriminatory law, a law with a discriminatory purpose, or a law whose practical operation favors in-state economic interests over out-of-state competitors is generally invalid. Protectionism is the central concern. The state must show a legitimate local purpose that cannot adequately be served by a reasonable nondiscriminatory alternative. A state cannot defend economic favoritism merely by invoking local jobs, local businesses, or local tax revenue.

If the law is evenhanded and only incidentally burdens interstate commerce, apply Pike balancing: the law is invalid when the burden imposed on interstate commerce is clearly excessive in relation to the putative local benefits. Consider the actual burden on interstate operations, the strength of the local benefit, and whether less burdensome alternatives exist. Ordinary health and safety rules often survive, but a state-specific requirement that forces a national industry to alter its system may impose a substantial burden.

The market-participant exception permits a state acting as a buyer or seller to favor its own residents in that market. A state may prefer local businesses when selling state-owned timber or purchasing supplies for a state project. It may not use market participation as a pretext to regulate transactions outside the market in which it is participating. A state selling timber generally cannot dictate where a buyer must process all timber after the sale.

Congressional authorization removes the dormant Commerce Clause objection to a state measure, including a measure that would otherwise discriminate or impose an undue burden. Authorization must be read from the federal law supplied. Authorization does not erase other constitutional limitations.

Worked Pike application: A state requires every truck entering its territory, including trucks merely passing through, to stop at a state inspection station. The inspection duplicates federal inspections, costs interstate carriers substantial time and money, and produces little additional safety benefit. The law applies to in-state and out-of-state trucks alike, so it is not facially discriminatory. It is nevertheless vulnerable under Pike because the burden on interstate transportation is clearly excessive compared with the marginal local benefit. The state is regulating rather than participating in a market, and no congressional authorization appears.

Federalism Sorting Drill: Four Questions at the Collision Point

Use this executable sequence when a fact pattern contains both federal and state action:

  1. Identify the immediate target. Is the state regulating private conduct, the federal government, a federal instrumentality, or interstate commercial activity?
  2. If federal and state rules regulate the same subject, read the federal text for express preemption, then ask about field occupation, impossibility, and obstacles to federal objectives.
  3. If the state measure directly taxes or regulates the United States or a federal instrumentality, test intergovernmental immunity even if the measure is neutral.
  4. If federal law directs a state legislature or state official to enact, administer, or enforce federal policy, test anti-commandeering. A federal rule directed at private actors follows a different route.
  5. If a state measure burdens interstate commerce and no federal authorization appears, test discrimination, Pike burden, and market participation.

High-Yield Points - ⚡ Biggest Takeaways

Express, field, impossibility, and obstacle preemption are separate routes to federal priority. Direct state taxation or regulation of federal instrumentalities is barred by intergovernmental immunity. Congress may regulate private actors but cannot commandeer state legislatures or executive officials. Discriminatory state laws usually fail, while neutral burdens receive Pike balancing. Market participation and congressional authorization can remove a dormant Commerce Clause objection.

Flashcards: The nation and the states

                    1. 1. What are the key steps to analyze a federalism issue involving both federal and state action?

                      Show answer

                      1. Identify the target (private conduct, federal government, instrumentality, or interstate commerce). 2. Check for federal preemption. 3. Test intergovernmental immunity if a state taxes/regulates the federal government. 4. Test anti-commandeering if federal law directs state officials. 5. Test dormant Commerce Clause if a state measure burdens interstate commerce.

                    2. 2. What are the three forms of federal preemption?

                      Show answer

Express preemption occurs when Congress expressly displaces state law; implied preemption may be field or conflict preemption. Conflict preemption includes impossibility and obstacle preemption.

                    3. 3. What is the presumption against preemption, and when does it apply?

                      Show answer

Courts presume Congress did not intend to displace state law when the state rule concerns an area traditionally regulated by states and the federal statute's scope is unclear. The federal statute is then read narrowly to preserve state authority unless a clear preemptive purpose is shown.

                    4. 4. What is the general sequence of analysis for a dormant Commerce Clause challenge to a state measure?

                      Show answer

First, determine whether the state is acting as a market participant. If not, ask whether the measure discriminates against interstate commerce—facially, in purpose, or in practical effect. A discriminatory measure is generally invalid unless Congress has clearly authorized it or the state proves a legitimate local purpose that cannot be adequately served by reasonable nondiscriminatory alternatives. If the measure is evenhanded but incidentally burdens interstate commerce, apply Pike balancing: it is invalid only if the burden on interstate commerce is clearly excessive in relation to the putative local benefits.

                    5. 5. When may a state discriminate against interstate commerce as a market participant?

                      Show answer

A state may favor its own citizens when it is acting as a market participant, such as a buyer or seller, rather than as a market regulator. The exception does not permit discrimination in downstream markets or regulation of private parties outside the transaction.

                    6. 6. When does field preemption generally apply?

                      Show answer

Field preemption applies when federal regulation is so pervasive that it occupies the entire regulatory field, or when a federal interest is dominant and the state law would interfere with it. Congressional intent to occupy the field is controlling.

                    7. 7. What is the congressional-authorization exception to dormant Commerce Clause limits?

                      Show answer

Congress may authorize state laws that would otherwise violate the dormant Commerce Clause because Congress has power to regulate interstate commerce. The authorization must be clear enough to show that Congress intended to permit the discrimination or burden.

                    8. 8. What is the anti-commandeering rule?

                      Show answer

The federal government may not require states or their officials to enact, administer, or enforce a federal regulatory program. Congress may regulate private parties directly and may condition federal funds on compliance with valid conditions.

                    9. 9. What is the Supremacy Clause rule when valid federal law conflicts with state law?

                      Show answer

The federal law prevails, and the conflicting state law is invalid to the extent of the conflict. Federal law must be constitutionally valid to have supremacy.
