Misrepresentation, defamation and privacy Flashcard Deck - 10 Cards
Flashcard 1: What is the common-law absolute privilege for defamation?
Answer: An absolute privilege protects certain statements, such as statements made during judicial or legislative proceedings, even if the speaker acts with malice. The statement must ordinarily be relevant to the proceeding.
Flashcard 2: When is a defendant liable for negligent misrepresentation?
Answer: A defendant who, in the course of business or a profession, supplies false information for the guidance of others is liable for negligent misrepresentation when the plaintiff justifiably relies and suffers pecuniary loss, if the defendant failed to exercise reasonable care. Under the Restatement majority approach, liability generally extends to a limited group of persons for whose benefit or guidance the information was supplied.
Flashcard 3: What defenses commonly apply to privacy torts?
Answer: Consent is a complete defense within its scope, and truth generally defeats false light and publication-of-private-facts claims. Matters of legitimate public concern, newsworthiness, and constitutional protection for public discussion may also defeat privacy liability, subject to the specific tort and jurisdiction.
Flashcard 4: What are the elements of intrusion upon seclusion?
Answer: The defendant must intentionally intrude, physically or otherwise, upon the plaintiff’s private affairs or seclusion in a manner that would be highly offensive to a reasonable person. The plaintiff need not prove publication or economic loss.
Flashcard 5: What are the four privacy torts?
Answer: They are intrusion upon seclusion, appropriation of name or likeness, publication of private facts, and false light. Each requires conduct highly offensive or otherwise legally objectionable under the applicable tort, and false light additionally requires publicity placing the plaintiff in a highly offensive false portrayal.
Flashcard 6: What is the truth defense to defamation, and who bears the burden?
Answer: Truth is an absolute defense to defamation, even if the statement causes reputational harm or was published with ill will. The defendant generally bears the burden of proving substantial truth.
Flashcard 7: What are the elements of fraudulent misrepresentation?
Answer: The defendant must make a material misrepresentation of fact, with knowledge or reckless disregard of its falsity, intending to induce reliance; the plaintiff must justifiably rely and suffer damages. The majority rule requires the misrepresentation to concern a past or existing fact, not mere opinion or prediction.
Flashcard 8: What are the elements of a defamation claim?
Answer: The plaintiff must prove a defamatory statement concerning the plaintiff, publication to a third person, fault by the defendant, and reputational harm or presumed damages when permitted. The statement must be understood as asserting a fact rather than pure opinion.
Flashcard 9: What fault standard applies when the plaintiff is a public official or public figure in a defamation action?
Answer: The plaintiff must prove actual malice: the defendant knew the statement was false or acted with reckless disregard for whether it was false. This is a constitutional requirement, and it must be shown by clear and convincing evidence.
Flashcard 10: What is the difference between an opinion and an actionable misrepresentation?
Answer: A statement of opinion is generally not actionable unless the speaker implies undisclosed defamatory or false facts, or has superior knowledge making the opinion misleading. A statement about a fact, including a present condition, may be actionable if it is false, material, and relied upon.
